At Spring Lakes Watersports, we take your health and safety seriously. We wish to highlight that any of the activities available can be potentially hazardous physical activities and that participation can lead to a risk of injury and even death. We are committed to protecting and respecting your privacy. The information you provide to us will only be used by us to provide the services we offer and to inform you of any news/offers that may be of interest to you in the form of occasional email newsletters unless you opt out of this. As the responsible person, I can confirm that myself /all parents and/or guardians of the group I have organised to participate in activities at Spring Lakes have been informed of and understand all points of this activity agreement.
Additionally, that by this Activity Agreement/Waiver I confirm the participants are competent swimmers (able to swim 50metres unaided) and are confident in deep open water, additionally, the participants have a reasonable level of fitness and ability and would be able to exit the water without assistance should the need arise. (We can provide cover for any issues but we must be made aware prior to booking to make any special arrangements) I, the organiser of the participants, confirm as follows:
1. I understand and accept that in participating in activities at Spring Lakes that there is an element of danger and risk of physical or emotional injury to both the participants and others. We wish to highlight that all water sports can be a potentially hazardous physical / mental activity and that any swimming can lead to a risk of injury and even death.
YOUR OBLIGATIONS 1.1 You understand and accept that:
a) In participating in watersports activities there is an element of danger and risk of injury to yourself, which risk you assume with full knowledge of the inherent dangers related to all watersports /activities /facilities and in circumstances where you have been given an opportunity to make all enquiries regarding the particular hazards of which you may need to be aware.
You therefore undertake all activities at your own risk and agree to hold Colina Property Services Ltd trading as Spring Lakes, its employees, and all other persons harmless in the event of harm or injury caused in consequence of any failure on your part to take adequate care for the safety of others and/or failing to comply with any of the obligations as set out herein.
You will fully indemnify Spring Lakes, its agents and employees against any claim brought by a third party for loss, damage, injury or death which has been caused by any action or omission of mine or any act or omission of any participants of which I am the organiser of the participants whose supervision is wholly or partly my responsibility at the time of the relevant act or omission that would, if they had agreed to the same with full capacity to do so, amount to a breach of these Terms and Conditions or which amounts to negligence or a wilful act or omission.
b) In participating in watersports activities that there is not only an element of danger and risk of injury to yourself but also to others and consequently you undertake to use the Company’s equipment and facilities and to conduct yourself while on the Company’s premises in a sensible and responsible manner and in compliance with all notices, instructions and directions as published or displayed from time to time and in compliance with any instruction given to you by any authorised person in the Company’s employment or control. Activities to include are open waters swimming, kayaking, paddle boarding, fishing, information you provide to us will only be used by us to provide the services we offer and to inform you of any news/offers that may be of interest to you in the form of occasional email newsletters unless you opt out of this. Please check that your information is up to date before signing and update as necessary.

b) In participating in watersports activities that there is not only an element of danger and risk of injury to yourself but also to others and consequently you undertake to use the Company’s equipment and facilities and to conduct yourself while on the Company’s premises in a sensible and responsible manner and in compliance with all notices, instructions and directions as published or displayed from time to time and in compliance with any instruction given to you by any authorised person in the Company’s employment or control. Activities to include are open waters swimming, kayaking, paddle boarding, fishing, inflatable rides, pedalo’s, fun city, aqua park, café, pods, beach, Scuba Diving, functions and camping; the company spring lake reserves the right to add or remove activities. You have read and acknowledged that conduct of the type set out below would amount to a breach of this paragraph.
1.2 You confirm that:
a) You will not use the Company’s cable skiing facility without (a) having attended a first timer’s training session; and/or (b) meeting the Minimum Standard (as defined in Section 3 below);
b) You will not use the aqua park without having first attended a safety briefing;
c) You are in good state of health and free from any injury, medical condition, disease or illness which may be aggravated by participating in watersport activities or which may make it unsuitable for you to participate in such activities; and agree to notify staff of any illness or medical condition that we should be aware of; acknowledge that the activities provided by Spring Lakes are not available to pregnant women and that by accepting these terms I confirm that all participants are not pregnant. I acknowledge that cosmetic body enhancements including but not limited to false nails, non removable jewellery and other surgical additions could cause injury to the participants of any activities. Spring Lakes strongly advises any participants to remove these if possible before participating or not to participate, as Spring Lakes will not be held accountable for any injury caused to the participants and
d) You are able to swim 50m unassisted and are confident in deep open water. e) You will supervise any child or children in your care at all times at the beach resort, when in the water or on land, all non swimmers attending the beach must wear a life jacket when in the water; on any activity which requires adult supervision because of age restrictions.
The minimum standard for Cable use without specific instruction is as follows:
Agree that the participants will only carry out moves and tricks that are within the participant’s skill and fitness levels and of which the participants are able to retain control of at all times. That the participants will also only use features that the participants have the ability to use within the participants skill and fitness levels.
I acknowledge and agree that the participants are responsible for their own safety and the safety of others whilst participating in activities. I understand that the activities may be undertaken without direct supervision following safety instructions and agree that the participants will at all times wear any protective equipment provided by or required by Spring Lakes to be worn and will ensure that the participants comply with all instructions given at any time during the activities by Spring Lakes by any of its staff. I further acknowledge and agree that the participants will wear buoyancy aids where required and will not remove this at any point whilst in the water.
I agree that the participants shall not participate in any activities provided by Spring Lakes unless the participants have undertaken Spring Lakes safety and induction procedures and processes in relation to the activities and confirm that the participants will comply with these at all times whilst on the premises from which the activities will be carried out.
I agree and promise to ensure the participants accept to be responsible for any and all risks existing and subsisting in the activities. I acknowledge that participation in the activities is voluntary and that the participants elect to participate despite the risks and agree to accept the consequences of so doing.
I confirm and agree that the participants will comply with all age and height restrictions specified by Spring Lakes. The participants acknowledge that if they do not comply with any age or height restrictions or any other requirements put in place by Spring Lakes from time to time, they will not be able to participate in the activities and agree that they will promptly withdraw upon request by Spring Lakes or any person acting on behalf of Spring Lakes
The participants consent and agree to the use by Spring Lakes of CCTV monitoring for training, health and safety and security purposes.
Spring Lakes consents to the participants and accompanying members of their group undertaking photography for their own non-commercial purposes only and for no other purpose whatsoever. However, the participants and accompanying members of their group are not to use any drone type equipment at Spring Lakes, without seeking the correct permits, having the required training, licenses, and insurance, with supporting documentation being available, to operate the equipment, before seeking the approval of the senior management at Spring Lakes.
You will at all times:
a) Avoid using the facilities in a manner which might endanger other persons using the facilities.
b) Refrain from using the facilities under the influence of drugs or alcohol.
c) Refrain from using ramps, sliders and kickers without receiving authorisation and instruction from the cable operator.
d) Wear a buoyancy aid and other safety equipment provided by us at all times whilst in the water and only remove when instructed to do so.
e) Obey safety advice and signage and all instructions given to you by authorised personnel. f) Treat the Company’s property and the facilities with respect and care.
1.5 You acknowledge that the above are not intended to be an exhaustive list of safety rules. You also acknowledge that the Company may require you to leave the facilities without refund if you break any of the above mentioned rules.
1.6 You undertake to fully indemnify the Company, its directors, agents and employees against any claim brought by any third party for loss, damage, injury or death which has been caused by any action or omission of yours or any act or omission of any child of which you are the lawful parent or guardian or any child whose supervision is wholly or partly your responsibility at the time of the relevant act or omission that would if they had agreed to the same with full capacity to do so amount to a breach of these Terms and Conditions or which amounts to negligence or a wilful act or omission.
1.7 All children under 14 years of age must be accompanied by an adult when on the Company’s property. The adult must remain on the site for the duration of the child’s visit and must supervise them appropriately at all times.
1.8 I undertake to provide truthful answers to the Health Questionnaire applicable to all activities and draw attention to any medical issues revealed before engaging in activities.
1.9 You agree to grant us permission to photograph, video and audio record you whilst on the premises or using the facilities. In addition, you grant us the right to use and reproduce, for any purpose and without compensation, any photographs, digital or electronic images, audio recordings, movies or videos taken of yourself while at the premises. You must contact a member of staff if you do not wish to agree to this term.
1.10 You understand that you need to arrive on site at least 60 minutes before a booked activities allotted time slot or your aqua park session, and that failure to do so will result in the time slot/session being lost without compensation.
1.11 You understand that you may be asked for proof of I.D at any age. You must be able to produce documents if necessary. Failure to do so can result in being refused to partake in activities.
1.12 You acknowledge that nothing in the Terms and Conditions is intended to avoid liability on the part of the Company for personal injury or death caused by the negligence or wilful act of any authorised person in the Company’s employment or control.
1 / 2 Before you can participate in activities at Colina Property Services Ltd trading as Spring Lakes you must have read, understood and agreed to the Terms & Conditions.
Car’s, personal items & equipment are bought to site at the owners risk and must be covered with the appropriate insurance to cover 3rd party risk the company will not be held responsible for damage or loss of any such property. Lost & Found property – the company has no obligation to hold onto any property left on site and subsequently found and it will be disposed of after a reasonable time period if unclaimed. We respect the right to ask for proof of ownership prior to returning any items. Lost property, The company is under no obligation to retrieve any items lost in or around Spring Lakes.
Spring Lakes are natural lake’s and as such may contain naturally occurring environmental hazards, conditions, plant’s & animal life. We regularly test for any such hazardous conditions.
Surfaces on site may be slippery due to water & plant based life, we advise suitable footwear is worn at all times to prevent slips, trips and injury caused by sharp objects.
Please be aware all our activities on offer have specific participation rules including but not limited to age, goggles /camera’s and other personal equipment may not be permitted on some activities. Under no circumstances may any participation in activities take place following the consumption of any alcohol we reserve the right to remove you from the activity and no refund will be given.
Any water entry is strictly forbidden when unsupervised or not booked onto an activity that is water based such as but not limited to fishing and camping.
No music must be played on site without the permission of a manager and never at a volume that could impact on other site users.
No alcohol to be consumed on site that has not been purchased from Spring Lakes & all alcohol purchase & consumption rules must be adhered too at all times. We reserve the right to remove any person from site deemed(by any person employed by Spring Lakes) in a drunken state.
The Spring Lakes site can be used by 3rd party organisations / businesses to conduct training or events and do so under their own rules / safety protocols / risk assessments / insurances & waivers but must conform to Spring Lakes rules at all times or if not doing so having made Spring Lakes aware in writing and agreements in place to cover any such breaches.
Unauthorised access to areas that are closed or restricted are strictly off limits, anyone found within these areas may be asked to leave the site.
